Blizzard Sued for Copyright Misuse

A lawsuit has just been filed in California against Blizzard, Vivendi Universal Games (Blizzard's parent company), and the Entertainment Software Association to restore the right of Florida resident Brian Kopp to sell an unoffical guide to the World of Warcraft online. eBay blocked him from selling it when Blizzard invoked the Digital Millennium Copyright Act (DMCA), asserting that the guide violated its copyright in the game. In an email to David Farber's Intereting People mailing list, Paul Levy of Public Citizen, the group representing the plaintiff, writes, "Vivendi's position is apparently that merely writing about their game infringes their copyright even if the author incorporates none of the company's text or storyline."
